In order to accurately punish crimes involving fentanyl substances in accordance with the law, the Supreme People's Court, the Supreme People's Procuratorate, and the Ministry of Public Security jointly issued the "Opinions on Several Issues Concerning the Application of Law in Handling Criminal Cases Involving Fentanyl Substances" (hereinafter referred to as the "Opinions"), which were released on September 23. The Opinion strictly adheres to relevant laws and regulations such as the Criminal Law and the Criminal Procedure Law, and provides guidance on the application of laws in criminal cases involving fentanyl substances. It emphasizes the strict punishment of fentanyl related substance crimes in accordance with the law, and resolutely safeguards the lives, health, and social harmony and stability of the people.
The Opinion consists of 18 articles, mainly clarifying the conviction and sentencing standards for fentanyl based substance crimes, dividing fentanyl based substances into two categories: medicinal and non medicinal. Medicinal fentanyl based substances refer to the quantity standards for fentanyl stipulated in the Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Law in the Trial of Drug Crime Cases, while non medicinal fentanyl based substances refer to the quantity standards for heroin stipulated in the Criminal Law. The Opinion also stipulates the scope of fentanyl like substances, basic requirements for collecting evidence, basic rules for determining knowledge, recovery of illegal gains, jurisdiction over related cases, etc., and refines the work responsibilities of the public security, procuratorial and judicial organs in handling criminal cases involving fentanyl like substances, providing clear basis for law enforcement and judicial cases.
At the same time, the Supreme People's Procuratorate and the Ministry of Public Security have also issued the "Regulations on the Standards for Filing and Prosecuting Fentanyl like Substance Crimes".
It is reported that in the next step, the Supreme People's Court, the Supreme People's Procuratorate, and the Ministry of Public Security will jointly strengthen the implementation work, continuously strengthen the legal punishment and comprehensive management of fentanyl related substance crimes, and continue to promote the high-quality development of drug control work.
