After retrieving surveillance footage from Ms. Chen's home and residential area, the police found a blind spot where the object was thrown and were unable to locate the specific infringer. So Ms. Chen sued the homeowners' committee of a certain community and demanded compensation of 1 yuan for the loss.

The Changyang County People's Court held that the damaged chili seedlings in Ms. Chen's home were broken by the falling mineral water bottle. As the specific infringer cannot be determined in this case, combined with the court investigation and on-site visits, the defendant community owners' committee has certain faults in fulfilling safety measures and should bear corresponding responsibilities.

Wan Shurong, Deputy Chief Judge of the Comprehensive Court of Changyang County People's Court, stated that throwing objects from high altitude, if it poses a threat to the personal safety of others or the safety of public and private property, regardless of whether it causes actual damage, is illegal.

The Law of the People's Republic of China on Public Security Administration Punishments, which came into effect on January 1st this year, stipulates that those who throw objects from buildings or other heights that pose a threat to the personal safety, public or private property safety, or public safety of others shall be detained for up to five days or fined up to one thousand yuan; Those with serious circumstances shall be detained for not less than ten days but not more than fifteen days, and may be fined not more than one thousand yuan.
