The Supreme People's Court issues protection and regulation for lawyers' participation in litigation typical cases
2026-04-07
On April 7th, the Supreme People's Court issued 5 typical cases to ensure and regulate lawyers' participation in litigation. The right to practice as a lawyer originates from clear legal provisions and is essentially an extension of the litigation rights of the parties involved. Respecting and supporting lawyers to perform their duties in accordance with the law is to respect the legitimate rights and interests of the parties involved and to uphold judicial fairness. In Case One released this time, the People's Court actively communicated and coordinated, ensured the connection between assisting lawyers and commissioned lawyers, and protected the defendant's right to choose a defense counsel, as well as the right to meet with lawyers and review case files; In Case 2 and Case 3, the people's court promptly and effectively stopped the infringement of lawyers' right to practice, and protected lawyers' right to express opinions and personal rights in accordance with the law. The people's courts continue to strengthen the protection of lawyers' right to practice, ensuring that any infringement of lawyers' right to practice is promptly corrected, and laying a solid foundation for lawyers to perform their duties normally. Currently, lawyers strictly perform their duties in accordance with laws and regulations such as the Lawyer Law, maintain normal trial order, and uphold social fairness and justice. However, there are also a very small number of lawyers who engage in illegal and irregular practices and should be regulated in accordance with the law. For example, in Case 4 released this time, lawyer Zheng intentionally distorted facts, maliciously misled public opinion, and seriously threatened the personal safety of the judge; In case five, lawyer Dong claimed to be "familiar with court staff" and solicited business, falsely claiming that he needed to "handle judges" to demand property from the parties involved. Regulating the above-mentioned violations of lawyer practice norms and professional ethics in accordance with the law is necessary to maintain judicial authority and credibility, safeguard the legitimate rights and interests of the people, and maintain the image and reputation of the lawyer community. According to the Supreme People's Court, in the next step, the people's courts will continuously improve the institutional mechanisms to safeguard the rights of lawyers to practice and regulate their practice activities, fully leverage the active and important role of lawyers in comprehensively governing the country according to law, promote judicial fairness and social governance, and better safeguard the legitimate rights and interests of the people.
