Macao establishes a system of paid use of sea areas

The reporter learned from the press conference of the Executive Council held on the 30th that the Macao SAR Executive Council has completed the discussion of the draft law of the "Law on the Use of Sea Areas", which clarifies that sea areas are public property, establishes a system of paid use of sea areas, and requires the holder of sea area use rights to pay sea area use fees. The relevant bill will be submitted to the Legislative Council for review. It is reported that in December 2015, the State Council of the People's Republic of China issued Decree No. 665, which clearly defined the sea area of the Macao Special Administrative Region as 85 square kilometers. To effectively manage the sea area, the Macao SAR government has the authority to promote the formulation of regulations on sea area management. Article 8 of Law No. 7/2018 of the Macao Special Administrative Region on the Outline of Maritime Management stipulates that the Macao Special Administrative Region government may approve the use of maritime areas through grants, permits, or other means. The approval system is regulated by specialized laws and regulations. To this end, the Macao SAR government has launched legislative work on the "Law on the Use of Sea Areas" and formulated a legal system on the use of sea areas to specifically implement the provisions of Law No. 7/2018. The draft of the Law on the Use of Sea Areas mainly includes clarifying that sea areas belong to public property; Establishing private entities to obtain the right to use sea areas through dedicated grants or temporary use permits; Clarify the scope of the right to use the sea area, and grant the holder of the right to use specific sea areas according to the sea area, space, purpose, and conditions specified in the certificate during the validity period of the certificate; Establish conditions for the use and utilization of sea areas, promote rational development and sustainable use of sea areas, and eliminate the phenomenon of abandoned and idle sea areas; Establish a system of paid use of sea areas, and the holder of sea area use rights must pay a sea area use fee; Clarify the consequences of terminating the right to use the sea area, as well as any compensation, removal of infrastructure and temporary facilities set up in the sea area, and relevant provisions for vacating the sea area; Actively protect the marine environment and reduce the impact of marine projects on the marine environment.
